Introduction of Strata Management (Compounding of Offences) 2019

Whilst we see a lack of enforcement being taken against a party who contravenes the provisions in Strata Management Act 2013 and Strata Management (Maintenance and Management) Regulations 2015, it is encouraging to see that the Minister has made further regulations (by virtue of Section 150(2)(e) of the Strata Management Act 2013) relating to compounding of offences.

These set of regulations were gazetted on 22.4.2019 (today) and will take effect on 2.5.2019.

The Strata Management (Compounding of Offences) Regulations 2019 lists down the offences which can be compounded in the 1st Schedule. Pursuant to Regulation 4, the Commissioner of Buildings (COB) is allowed to issue a notice of offer to compound after investigation is completed and offence is found to be committed.

The list of compoundable offences are: Ss 6(6), 9(5), 10(7), 11(7), 12(9), 14(5), 15(4), 18(2), 26(5), 27(4), 29(3), 30(2), 30(3), 34(3), 48(4), 49(3), 50(4), 51(3), 54(5), 55(4), 57(2), 62(5), 72(2), 72(3), 78(3), 89(5), 91(2), 92(6), 151(2) of the Strata Management Act 2013 and Regs 6(5), 7(4), 9(7), 9(8), 19(2), 21(5), 25(3), 30(2), 32(5), 34(2), 43(5), 44(3), 63(2) and 70 of the Strata Management (Maintenance and Management) Regulations 2015
